Welcome to CountryQuest! These Terms of Use ("Terms") govern your use of our gamified travel app (the "App"). By accessing or using the App, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use the App.
1. Use of the App
The App allows you to visit and "capture" real-world places of interest, earn points, and compete with other users. Your use of the App must comply with all applicable laws and regulations. You agree not to use the App for any unlawful or prohibited purpose, or in any manner that could damage, disable, overburden, or impair the App.
2. User Accounts
To access certain features of the App, you must create an account using your Google, Apple, or email credentials. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
3. Location Data
The App requires access to your device's location data to verify your presence at specific locations. By using the App, you consent to the collection and use of your location data as described in our Privacy Policy.
4. Points and Leaderboards
The App features a points system and leaderboards that allow you to compete with other users. Points have no monetary value and cannot be redeemed for cash or any other form of compensation. We reserve the right to modify, suspend, or terminate the points system or leaderboards at any time without notice.
5. Intellectual Property
All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are the exclusive property of CountryQuest or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or in any way exploit any of the content or materials in the App without our prior written consent.
6. Termination
We reserve the right to terminate or suspend your account and access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
7. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted or error-free, nor do we make any warranty as to the accuracy, completeness, or reliability of any information obtained through the App.
8. Limitation of Liability
To the fullest extent permitted by law, CountryQuest shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, or business interruption, arising out of or in connection with your use of or inability to use the App, even if we have been advised of the possibility of such damages.
CountryQuest is not responsible for any harm, injury, or damages you may suffer while visiting locations suggested or featured in the App, including but not limited to places that may be in dangerous or hazardous areas. You acknowledge and agree that it is your responsibility to research and assess the safety and suitability of a location before visiting it. By using the App, you assume all risks associated with visiting any locations and agree that CountryQuest shall not be held liable for any injuries, losses, or damages that occur during such visits.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the country in which CountryQuest is headquartered, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction for the resolution of any disputes arising out of or relating to these Terms or your use of the App.
10. Changes to These Terms
We may update these Terms from time to time in our sole discretion. If we make material changes, we will notify you by posting the updated Terms in the App or through other communication. Your continued use of the App after such changes indicates your acceptance of the new Terms.
